Do priority dates matter now?
with the deluge of applications that will be filed,will the priority dates matter anymore?
lets say someone with a priority date of Dec 2006 (EB2-ROW) applied for 485 in Feb 2007...will his case be processed before a person with a September 2005 priority date that filed in July 2007 (EB2-India)?
so other than allowing us to file the 485 the priority date has no value?

I'm going to guess that the same folks in the Tea Party screaming about the deficit will somehow find this breaking news to be irrelevant. Of course, they also think the sky's the limit when it comes to spending on immigration enforcement. So much for being consistent. I'm in France until Sunday and blogging from my iPad. If your old visa has not beenexpired at the time of re-entering . You will need to carry your new approved I-797. But your I-94 would have the expiration date as that of the expiration date as on your old Visa.
I had the same situation last year and the processing went smoothly at port of entry, but you may check for any chages in the regulations.

I came in on an F1 and got transfered to a H1B without leaving the country.
My H1 was approved for 3 years ie till 2012.
Due to problems at my work place, my H1 got revoked by my employer.
I'm in the medical profession, hence, jobs are few and far between if removed form a training program such as I was in. The next cycle of jobs dont start employment till July 2011.
I am currently within the 180 day limit.
What are my options? My countrys consulate is known to be tight fisted with visas, especially as I have overstayed since I lost my job abruptly.
If my fiance and I do get married, am I eligible for for adjustment of status?
Please help!

The ridiculous amount of time DOL is spending on the Perm Audits in just incomprehensible. They still approved 1 may be 2 application a day, thats my assumption. Last time I saw they are still processing audited-applications filed in Aug/Sept 2007.
Any word on how what their plan is? They really do have bunch inefficient people working for government!!!

You cannot file 485. You will have to start the process from scratch. However, you can use the priority date from the approved 140.

My wife recently got her H4 extension approved. She got her I-797 approval form. While going for H4 stamping, Is she required to carry my original H1B I-797 also?

My I-485 was filed this July. My wife and I got FP notices for Nov 20. But my wife is currently in India and I will be in India too on Nov 20. So we will have to reschedule at least for my wife.
My question is, has anyone who filed their I-485 after July 2 rescheduled their FP appt and got a new appt date? I'm in the San Jose area.

My law firm has said they will receive FP notices and then they will forward it to me. I got my AP & EAD in mail directly from USCIS.

Interim EAD's are no longer an option since Sep 2006
In case of emergency travel it is possible to get AP from local office

You have to return both I-94's while ticketing ie before exiting and while entering at POE IO will give you new I-94 based on AP as Paroled AOS pending..
Ofcourse keep your copy of I-94 from your H1 Extension I-797 approval notice.

I have a question regarding the H1 / H4 status of my spouse.
My spouse entered US in 2006 on H4 visa (valid till 2008 ). In 2007 she applied for H1B and the I 797 start date is October 2007. She did not apply for any status adjustment (from H4 to H1). She did apply for SSN using the EAD and presently not working.
I just wanted to know, what is her visa status now. Is it H4 or H1?
