LC was approved in 08-20-07 but I-140 was not filed within 180 days according to new rules. has any body have this problem? will DOL or USCIS let it slip. please help.

I already have my 485 pending at NSC. My state comes under TSC jurisdiction.
Where should i file for my EAD, if I don't file concurrently with 485? at NSC where my 485 pending or at TSC?

Though CIS has your correct address, non-delivery could be due to a typo in the address, and the USPS sorting system was not able to sort this particular letter.

Hello Everyone,
Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year. This is apart from the salary Iam receiving right now (greater than the prevailing wage and less than LCA). Do I face any problem if I happen to go for H1B visa stamp. Could you also suggest me how to defend myself if I am asked the difference in the salary by visa officer. Thanking you all in advance.

I think once the I-140 application is filed based on the state of residence, USCIS can transfer it to any service center. The applicant doesnt have any control over it. As far as I know, the applicant cannot request for a change in service center.

As part of our campaign on these legislations (HR 5882, HR 5921 & HR 6039 ), I wrote to my congressman. Afte sometime I got a reply and I was suprised that he had personally signed it. I know many IV members have contacted their congressman/Senators and they might have got a reply back.
My idea is that we should all mail the responses we got from our law makers to IV core. They can collect these letters, highlight the positive responses the lawmakers have said and send them to the chairman of "Judiciary" committee. This way IV can raise its stature and be know as a organisation for Legal Immigrants who are doing the right thing by contacting the law makers.
Makes sense ?

Can you use your spouse's cross-chargeability after you have filed for your I-140 already?
How time consuming is this for the USCIS to acknowledge?
Does spouse also need to have a GC application filed at that time or if your spouse is from a non-retrogressed country but not working then you can use her also?
